Wyoming Marijuana Seeds: What Cowboy State Law Allows

Wyoming has no medical or adult-use cannabis program, and growing is a crime. Here is the law, the high-plains climate and the facts on seeds.

Quick answerNo. Wyoming has no medical marijuana or adult-use law, so growing from seed is illegal for everyone. Planting or cultivating marijuana is a misdemeanor, larger grows can bring felony manufacturing charges, and possessing more than 3 ounces is a felony. Colorado and Montana allow home grow, but Wyoming does not.

What Wyoming law says about growing from seed

Wyoming’s controlled substances law, in Title 35 of the Wyoming Statutes, treats marijuana as illegal for every purpose. Under W.S. 35-7-1040, anyone who plants, cultivates, harvests, dries or processes marijuana commits a misdemeanor punishable by up to six months in jail and a $1,000 fine. Prosecutors can also bring felony manufacturing charges under W.S. 35-7-1031 when the facts support it.

Possession is graded by amount. Three ounces or less of plant material is a misdemeanor with up to a year in jail and a $1,000 fine, and more than 3 ounces is a felony carrying up to five years, according to NORML’s Wyoming summary. Being under the influence is a separate misdemeanor.

There is no medical program. Advocates filed ballot initiatives for medical cannabis and decriminalization in 2021, as Wyoming Public Media reported, but the campaigns did not gather enough signatures to reach the ballot.

Wyoming's climate: high, dry and windy

On the 2023 USDA map, Wyoming runs from zone 3b in the Yellowstone country and high basins to 6a in a few low spots in the southwest. Cheyenne’s median last frost is May 12 and its first fall frost is about October 1, roughly 141 frost-free days. Casper gets only about 117, from May 26 to September 22.

Humidity is very low, so mold is rarely a concern. The real limits are altitude, wind and cold nights. Cheyenne sits above 6,000 feet, summer hail is common on the eastern plains, and steady wind dries soil and snaps tender stems.

Elevation decides everything. The Bighorn Basin and the Powder River country are lower and warmer, while mountain valleys in Sublette County can see frost in almost any month. Intense high-altitude sun and big day-to-night temperature swings, often 30°F or more, shape how every crop grows here.

What this means for Wyoming residents

Wyoming offers no card, permit or exception that makes a home plant legal. Bringing cannabis home from Colorado or Montana is also illegal under state law.

Any change would need the legislature or a successful citizen initiative, and Wyoming’s signature rules require support from voters in at least two-thirds of the state’s counties.

Growing anything on the high plains

Wyoming gardeners plan around a short window, cold nights and wind. Many rely on cold frames, row covers and south-facing walls just to ripen tomatoes, and an early September freeze can end the season on the plains before fall officially starts.

Collecting and storing seeds where the law permits

Some Wyoming residents keep seeds with an eye on Colorado or Montana, where adults can grow at home. Our guide on whether marijuana seeds are legal in the US explains the federal change for viable high-THC seeds scheduled for December 11, 2026.

Where keeping seeds is lawful, Wyoming’s dry air helps, but temperature swings hurt. Store them sealed in a cool, dark, stable spot, never in a truck or shed that bakes by day and freezes by night. Our storage guide has more. Germinating them in Wyoming is a crime.
