Idaho Marijuana Seeds: The Law Before the 2026 Vote

Idaho bans all cannabis, and voters face a constitutional amendment on November 3.

Quick answerNo. Idaho has no legal medical or adult-use cannabis, and growing even one plant is a felony. On November 3, 2026, voters decide HJR 4, which would let only the Legislature legalize marijuana. A 2026 medical cannabis initiative failed to qualify for the ballot.

What Idaho law says about growing from seed

Idaho is one of the strictest states in the country. Marijuana is a controlled substance under Idaho Code Title 37, Chapter 27, with no medical exception and no low-THC program that allows cultivation. Growing any number of plants, even a single seedling on a windowsill, is a felony.

NORML reports that cultivating up to 24 plants can bring up to 5 years in prison and a $15,000 fine, with mandatory minimum sentences starting at 25 plants. Possession of under 3 ounces is a misdemeanor, and a 2025 law (HB 7) added a mandatory minimum fine of $300 starting July 1, 2025.

Seeds are no loophole. Secondary legal summaries indicate Idaho’s statutory definition of marijuana covers seeds and excludes only sterilized seeds that can’t germinate, and viable hemp seed is reserved for growers licensed under the state’s hemp program. Germinating cannabis seeds in Idaho is illegal.

What this means for Idaho residents

Two efforts to change the law came up short in 2026. Kind Idaho’s adult-use initiative never turned in signatures by the May 1 deadline. On July 14, the Secretary of State said a medical cannabis initiative had about 58,000 verified signatures against roughly 70,700 required, and it also missed the district requirement, as the Idaho Capital Sun reported.

What voters will see is House Joint Resolution 4. The measure would amend the Idaho Constitution to give the Legislature sole power to legalize marijuana, narcotics and other psychoactive substances, which would block future citizen initiatives on the subject. It needs only a simple majority to pass. Lawmakers sent it to the ballot in 2025 by votes of 58 to 10 in the House and 29 to 6 in the Senate.

For now, every neighboring state except Wyoming has some form of legal cannabis, but bringing any of it back into Idaho is illegal, including products bought legally across the border.

Idaho's climate, for the record

Idaho spans USDA zones 3b to 7a. Boise sits in zone 7a, with a median last frost of April 24 and a first fall frost of October 21, about 179 frost-free days. Idaho Falls on the eastern Snake River Plain is zone 5b and averages only about 114 days, with frost possible by September 20.

Southern Idaho is dry. Boise gets about 11.5 inches of precipitation a year, most of it from November through May, and summer afternoon humidity averages around 24%. That means low mold risk but high irrigation needs, with Boise’s July highs averaging near 93°F.

High mountain valleys are another world entirely, where frost can strike in any month. North Idaho around Coeur d’Alene runs cooler and wetter, with July highs closer to 83°F. Wildfire smoke is a recurring late-summer problem statewide, and summer thunderstorms can bring flash floods in burn scars.

Storing and collecting seeds legally in Idaho

Idaho law offers residents no clear legal way to keep viable cannabis seeds, since state law appears to treat them as marijuana. If you’re moving to a state where home growing is legal, the safest plan is to buy seeds after you arrive. Our guide on whether marijuana seeds are legal in the US explains the federal side, including the Section 781 change on December 11, 2026.

Once you’re somewhere possession is lawful, storage is simple. Seeds keep best sealed in an airtight container with a desiccant pack, away from light, at about 40°F to 50°F. Idaho’s dry air is kind to seeds, but big temperature swings between day and night are not, so avoid cars, garages and sheds. A sealed jar in the back of a refrigerator holds a much steadier temperature.
